China AI: CAC Leads Release of New Rules on AI Agents in China

On 8 May 2026, the Cyberspace Administration of China (CAC), together with the National Development and Reform Commission (NDRC) and the Ministry of Industry and Information Technology (MIIT), jointly issued the Implementation Opinions on the Regulated Application and Innovative Development of AI Agents (Implementation Opinions).
The document is one of China’s first comprehensive policy frameworks specifically focused on “AI agents” - AI systems capable of autonomous perception, memory, decision-making, interaction, and execution. The policy follows the State Council’s broader “AI+” strategy and reflects growing government attention on agentic AI systems that can independently perform tasks, interact with digital and physical environments, and make decisions with limited human intervention.
The Implementation Opinions aim to balance innovation and risk control. While encouraging rapid commercialization and adoption of AI agents across industries, the policy also emphasizes security, controllability, compliance, and governance throughout the full lifecycle of AI agent development and deployment.
Defining AI Agents and the Regulatory Direction
The Implementation Opinions define AI agents as AI systems capable of autonomous perception, memory, planning, interaction, and execution. Regulators view AI agents as an important next-stage form of artificial intelligence that will increasingly connect digital systems with the physical world.
The policy focuses on four broad directions: strengthening technical infrastructure, establishing safety and governance rules, promoting industry applications, and building an open innovation ecosystem. Overall, the regulatory approach seeks to balance rapid development with risk control.
Building the Technical and Standards Infrastructure
The regulators aim to establish a standardized technical foundation for AI agents, including model capabilities, development frameworks, toolchains, and multi-agent collaboration systems. The policy specifically highlights long-term memory, task planning, tool usage, interoperability, and security monitoring capabilities.
The document also proposes a national standards system covering data exchange, interface protocols, security certification, and AI Agent Interconnection Protocols (AIP). In the longer term, regulators envision an “intelligent internet” infrastructure involving AI agent registration systems, digital identities, and trusted collaboration mechanisms.
Strong Focus on Safety and Governance
Safety governance is one of the central themes of the policy. The Implementation Opinions stress that AI agents must remain lawful, controllable, and aligned with mainstream social values, while addressing risks such as manipulative behavior, emotional dependency, privacy leakage, system failures, and false information generation.
The policy also places strong emphasis on decision-making authority and permission boundaries. Users must retain the right to know and the final decision-making authority over autonomous agent actions, and AI agents may not operate beyond the scope of user authorization.
Classification-Based Regulatory Approach
Rather than adopting a single uniform regulatory model, the policy introduces a classification and grading approach. Sensitive sectors such as finance, healthcare, and public services may face stricter filing, testing, and supervision requirements, while lower-risk applications may rely more heavily on self-assessment and industry self-regulation.
The policy also encourages the development of third-party compliance services, certification systems, and industry maturity assessments. In addition, regulators support industry credit evaluation mechanisms targeting misconduct such as deceptive marketing and technology misuse.
Broad Range of Target Application Scenarios
The Implementation Opinions identify a wide range of target application scenarios across scientific research, manufacturing, transportation, agriculture, finance, education, healthcare, government services, judicial systems, and public safety. The policy clearly aims to accelerate commercialization through practical deployment in real-world industries.
The document also specifically references embodied AI systems and robotics in areas such as logistics, hospitality, elder care, disaster response, and hazardous operations, signaling strong regulatory support for the future development of AI-powered robotics.
Promoting Open Ecosystems and Industrial Collaboration
The final part of the policy focuses on ecosystem building. Regulators encourage open-source AI agent development, the creation of AI agent software marketplaces, industry collaboration platforms, pilot projects, and standards coordination mechanisms.
The policy also encourages Chinese AI agent companies to expand internationally, while emphasizing the need to comply with local laws and cultural requirements in overseas markets. This suggests that companies will increasingly need to address both domestic and cross-border compliance considerations.

The Implementation Opinions are an important signal that China is moving from general AI governance toward a more detailed regulatory framework specifically targeting autonomous AI agents. The long list of encouraged application scenarios suggests that regulators expect AI agents to become a major part of China’s next phase of digital and industrial transformation.
For companies operating in China, the Implementation Opinions suggest several practical trends worth watching closely. These include increasing expectations around permission controls, traceability, compliance testing, lifecycle security management, interoperability standards, and sector-specific governance requirements. Businesses developing agentic AI systems, especially in sensitive industries such as finance, healthcare, education, transportation, or public services, should expect closer regulatory scrutiny as implementing rules and standards continue to emerge.
