China: MOA Issues Provisional Administrative Specifications for the Examination of Oppositions to Agricultural Plant Variety Rights

On 5 November 2025, the Office for the Protection of New Varieties of Plants under the Ministry of Agriculture and Rural Affairs (MOA) released the provisional Administrative Specifications for the Examination of Oppositions to Agricultural Plant Variety Rights (Specification). The Specifications took effect on the date of issuance.
Under China’s plant variety right (PVR) protection system, and as clarified in the Specifications, an opposition may be filed at any point from the date of the PVR application up to the day before the right is granted. While the 15-working-day announcement period before grant remains the final opportunity for interested parties to raise an opposition, it is not the only window for doing so. The newly issued Specifications provide comprehensive procedural rules governing the filing, acceptance, examination, and resolution of oppositions.
Scope and Definition of Oppositions
The Specifications define an opposition as a formal challenge filed by any organization or individual from the date of application up to the date prior to the grant of the PVR. Oppositions may be filed on the following grounds:
1) The applied-for variety poses risks to public interest or ecological safety;2) The variety does not belong to any genus or species listed in the agricultural plant variety protection catalogue;3) Multiple PVR applications have been filed for the same variety;4) The variety does not meet the novelty requirement;5) The variety does not meet the distinctness requirement;6) The variety does not meet the uniformity requirement;7) The variety does not meet the stability requirement;8) The denomination of the variety does not comply with the Regulations on the Naming of Agricultural Plant Varieties;9) There is a dispute regarding entitlement to apply or breeder attribution;10) The information in the application documents or the submitted propagation materials is inconsistent with the actual variety or contains inaccuracies;11) Other circumstances that do not satisfy the statutory requirements for granting PVRs.The PVR Office organizes the examination of oppositions, and designated examiners conduct both procedural and substantive review.
Requirements for Filing an Opposition
To initiate an opposition, the opponent must file a Notice of Opposition setting out the relevant facts, grounds, and supporting evidence. Foreign opponents without a residence or business establishment in China must appoint a duly established local agency. Evidence must be lawful, authentic, relevant, and properly formatted, including the required signatures or seals, certification of copies, and a complete evidence catalogue.
If the opposition documents include deficiencies - such as missing Chinese translations, insufficient factual grounds, missing evidence, or unclear application information - the examiner will issue a rectification notice. If the deficiencies are not corrected within the prescribed timeframe, or the rectification remains inadequate, the opposition will be deemed not filed.
Acceptance and Non-acceptance of Oppositions
If an opposition meets the formal requirements, the PVR Office will issue a Notice of Acceptance within five working days. If the opposition does not meet the acceptance criteria, for example, where the application has already been granted, rejected, withdrawn, terminated, invalidated, or expired, the PVR Office will issue a Notice of Non-acceptance. Oppositions that do not satisfy the statutory grounds or remain deficient after rectification will also be rejected at this stage.
Exchange of Statements Between the Parties
After accepting an opposition, the PVR Office will forward the opposition materials to the applicant, who must submit a written response within 60 days. Failure to respond without justification will result in the application being deemed withdrawn. Where necessary, the applicant’s response will be served on the opponent, who will then have 60 days to provide a reply. If no new facts or evidence are submitted after the expiry of these response periods, the exchange of statements and supporting materials is concluded.
Examination Procedures and Fact-finding
Examiners conduct a written review based on the parties’ submissions, evidence, and verified facts. Examiners may communicate with the parties or relevant third parties through telephone calls, meetings, or interviews, which may be documented where appropriate.
Where factual issues require technical verification, such as suspected duplicate filings or inconsistencies between submitted propagation materials and reference samples, the PVR Office may arrange molecular identification or field-based testing. Either party may request a re-examination of the identification results if they can provide reasonable grounds and supporting evidence.
Issuance of the Opposition Examination Opinion
Upon completing the examination, the PVR Office will issue a Notice of Opposition Examination Opinion to both parties. This opinion is generally issued within 12 months of the Notice of Acceptance, excluding the time required for technical identification. For cases involving complex legal questions or major disputes, examiners may convene internal discussions or seek expert consultation before finalizing the opinion.
The PVR Office does not adjudicate entitlement disputes. If such a dispute has already entered judicial proceedings, the Office may suspend the administrative procedure until a final court decision has been rendered.
Suspension and Resumption of Procedures
Where the opponent or applicant is involved in litigation concerning entitlement to apply for or hold the PVR, they may request suspension of the relevant procedures by submitting required documentation, including a court notice of acceptance. Once the court judgment or ruling becomes effective, the parties may request resumption of the procedures. If necessary, the applicant may also request a change in applicant identity based on the final judicial decision.
Comment
PVR practitioners may, where appropriate, file an opposition during the public announcement period against any PVR application that affects their legitimate interests. At the same time, PVR applicants should take proactive measures throughout the application process to to minimize the likelihood of oppositions being filed against their own applications. This includes ensuring that the variety fully meets the substantive requirements, particularly novelty, distinctness, uniformity, and stability, and maintaining accuracy, consistency, and traceability in trial data, propagation materials, and all application documents. Applicants should also secure clear entitlement to apply, choose compliant and non-conflicting denominations, and establish internal verification and documentation systems to prevent discrepancies that could trigger opposition. Through careful preparation and robust compliance management, applicants can significantly reduce the risk of oppositions and enhance the likelihood of obtaining a smooth and successful grant.
