On 30 October 2024, the China National Intellectual Property Administration (“CNIPA”) released its intellectual property statistics for the first three quarters of 2024. According to the statistics, utility model patents still account for more than half of the grant numbers of China’s patents, domestic enterprises are the main contributors to the granted patents, and the number of registered trademarks in China continues to grow significantly.
The proportion of domestic and foreign patent applications has not changed much regarding patents. As of the end of September 2024, China has 5.55 million valid invention patents, 11.63 million utility model patents, and 3.04 million design patents. Among them, domestic applications accounted for 94.54%; utility model patents accounted for 57.53%. Domestic enterprises are the main contributors to all the three types of patents, accounting for 73.2% of invention patents, 90.4% of utility model patents, and 71.3% of design patents. The most applied for by foreign applicants is invention patents, accounting for 84.19% of their applications.
From January to September 2024, the number of granted invention, utility model, and design patents are 817,500, 1,510,400, and 462,100 respectively. Among them, domestic applications accounted for 96.23%; utility model patents accounted for 54.14%. Domestic enterprises are still the main contributors to the three types of patents, accounting for 74.1%, 88%, and 72.3% respectively. The most applied for by foreign applicants is still invention patents, accounting for 79.76% of their filings this year. Meanwhile, CNIPA accepted 53,100 PCT international patent applications, of which 4,051 were submitted by foreign applicants, accounting for 7.63%.
Regarding trademarks, as of 30 September 2024, China has 48.90 million valid registered trademarks. The number of trademark registrations in the first three quarters of this year is 3.59 million, an increase of 0.45 million over the same period last year. From January to the end of September 2024, the cumulative number of opposition actions filed is 92,200, the cumulative number of opposition rulings is 76,826, and the ruling rate is 83.33%. A total of 318,660 review cases were submitted, 273,740 were ruled, and the ruling rate is 85.9%. Among them, the most submitted is the appeals for rejection, with a total of 249,393 filings, 210,041 rulings, and the ruling rate is 84.22%.
In terms of integrated circuit layout design, the number of applications in the first three quarters of 2024 is 8,325, and the number of approved registrations is 7,703. This is a slight decrease in the number of applications compared with the same period last year.
In conclusion, utility model patents are the most important component of Chinese patents, although their share has decreased this year. Domestic enterprises are the largest contributors to Chinese patents. The improvement of China’s trademark examination efficiency resulted in a steady increase in the number of Chinese trademark applications.
