China’s National IP Administration issues 2022 Filing Statistics
In early June 2023, the CNIPA released a comprehensive 133 page report on IP filing statistics for 2022. The original Chinese version of the report can be accessed here.
As for China trademarks matters, the key statistics are:
Trademark Application Filings- 7.516 million applications filed - 97.2% from domestic applicants and 2.8% from foreign applicants (212,000)- 5,827 applications filed through Madrid by Chinese applicants- 25,000 territory extension to China from foreign applicants
Trademark Application Examinations- Average length from filing to registration: 7 months- Success rates: Partial refusals: 14.4%, Full refusals: 33.6%
Trademark Oppositions- 146,000 filed - Average length of review time: 11 months- Oppositions supported 45.1%; partially supported 11.8%; dismissed 43.1%
Trademark Appeal/Review Cases- Appeals against full refusals - 423,000 filed- Appeals against partial refusals – 332,000 filed
China continues to be the busiest in the world for trademark filings for a number of reasons. It is a key market for sales as well as manufacturing, counterfeiting/squatting is still a major concern, and many China based online shopping sites continue to insist on local China trademark registration for the operation of online stores and the provision of sales in China. The State Administration for Market Regulation and China Customs have also has been pushing for local China trademark registration evidence for sales, marketing/promotions, and international trade matters.
We are expecting to see the 2022 numbers upheld during 2023 for China trademark matters.
